General causation
Malignant mesothelioma is the signature asbestos cancer. The association between amphibole and mixed asbestos exposure and pleural or peritoneal mesothelioma is among the most established causal links in occupational disease. Lung cancer and asbestosis are real files too, with a harder smoking and dose fight. A job title is not a diagnosis. Cosmetic talc alleged to contain asbestos is a different inventory on this site.
Specific causation / screening
A pathology-supported mesothelioma (or a qualifying lung-cancer / asbestosis file), plus a product- and premises-specific exposure history: what was used, where, whose product, for how long. Take-home (household) exposure is a recognized path. Bankruptcy trusts sit beside remaining solvent defendants. Product identification still wins or loses the case. Latency is often 20 to 50 years. That is why the clock is not the car-crash clock.
Injuries currently screened
- Pleural mesothelioma
- Peritoneal mesothelioma
- Lung cancer (asbestos, with smoking as a fight)
- Asbestosis
Timeline
1930s–1970s
Industrial use and knowledge
Shipbuilding, construction, power generation, and automotive friction products put asbestos into a generation of workplaces. Internal knowledge and warnings are a matter of public trial record.
1970s–1980s
Regulation and the first wave
OSHA and EPA restrict use. The modern plaintiff docket begins. MDL 875 later centralizes a federal products inventory in the Eastern District of Pennsylvania.
1990s–2010s
Bankruptcy trusts
Dozens of defendants reorganize under 11 U.S.C. § 524(g). Trusts pay a share. Solvent defendants remain in state court.
2010s–2026
The docket does not close
Mesothelioma incidence has declined slowly, not disappeared. Navy, shipyard, construction, brake, and take-home files still fill trial calendars. Cosmetic-talc mesothelioma is litigated on a separate track.
