General causation
The June 2021 recall identified degradation of PE-PUR sound-abatement foam. Personal-injury theories include respiratory injury and certain cancers. Many economic-loss claims resolved through class mechanisms; personal-injury remains diagnosis- and device-specific.
Specific causation / screening
A recalled serial number, duration of use, and a qualifying diagnosis. Device registration and serial photos win or lose the file.
Injuries currently screened
- Certain respiratory conditions alleged in the inventory
- Certain cancers alleged in the inventory
- Economic loss for recalled devices (separate from PI)
