Georgia (Apr. 21, 2025)
SB 68 and SB 69, both signed April 21, 2025. SB 69 was signed last. The two-year clock and the 50% bar did not move.

- If you share blame
- If you are 50% or more at fault, you recover nothing. Below that, your recovery is cut by your share of blame.
- Ordinary injury time limit
- 2 years. O.C.G.A. § 9-3-33. Tolling, discovery rules, and other claim types can change that. Use the time-limit tool, then have a lawyer confirm the subsection.
- Caps on pain and suffering
- No general dollar cap. SB 68 (2025) limits how lawyers may argue a dollar figure for pain and suffering to the jury (anti-anchoring).
What that actually means
The two-year injury clock (O.C.G.A. § 9-3-33) and the 50% bar (O.C.G.A. § 51-12-33) are the same rules Georgia already had. 2025 did not copy Florida's clock cut or Florida's 51% bar.
The seat-belt change is a filing date, not a crash date. SB 69 says O.C.G.A. § 40-8-76.1(d) applies to cases commenced on or after April 21, 2025. A suit already pending that morning stays on the old gag rule.
Negligent security (SB 68 § 6) and medical-bill evidence (SB 68 § 7, O.C.G.A. § 51-12-1.1) follow the injury. They apply only to causes of action arising on or after April 21, 2025.
