No-fault auto reform (2019) changed the daily economics more than a classic tort bill.

- If you share blame
- If you are more than 50% at fault, you recover nothing. At 50% or less, your recovery is cut by your share of blame.
- Ordinary injury time limit
- 3 years. MCL § 600.5805. Tolling, discovery rules, and other claim types can change that. Use the time-limit tool, then have a lawyer confirm the subsection.
- Caps on pain and suffering
- Auto noneconomic recovery is filtered by the no-fault threshold (serious impairment of body function, or death). Med-mal has its own noneconomic cap structure.
What that actually means
In Michigan, the auto insurance statute often matters more than the comparative-fault statute. Threshold, PIP choice, and attendant-care fights are the file.
Do not read a Florida HB 837 explainer and assume it describes Detroit.
