Contributory (any fault can bar you)3-year ordinary injury clock
North Carolina (contributory, still in force)
Still one of four contributory states. Last-clear-chance and gross-contributory doctrines are the workarounds, not a legislative rewrite.

- If you share blame
- If you are even slightly at fault, you may recover nothing. This is the harshest rule still on the books.
- Ordinary injury time limit
- 3 years. N.C. Gen. Stat. § 1-52. Tolling, discovery rules, and other claim types can change that. Use the time-limit tool, then have a lawyer confirm the subsection.
- Caps on pain and suffering
- No general PI cap. Contributory negligence is the practical cap: any fault can be a complete defense.
What that actually means
Contributory negligence means a 1% finding against you can zero the file. That is not a metaphor.
People moving from Florida or New York do not believe this rule until a deposition. Believe it first.
