- If you share blame
- If you are more than 50% at fault, you recover nothing. At 50% or less, your recovery is cut by your share of blame.
- Ordinary injury time limit
- 2 years. Ohio Rev. Code § 2305.10. Tolling, discovery rules, and other claim types can change that. Use the time-limit tool, then have a lawyer confirm the subsection.
- Caps on pain and suffering
- Noneconomic damages in many torts are capped, with exceptions for catastrophic injury. Confirm current figures and exceptions.
What that actually means
Ohio pairs a 51% bar with noneconomic caps and a two-year clock. Catastrophic-injury exceptions are where the real fight is.
Read the exception before you assume the cap.
